Divorce, Custody & Visitation in Tennessee

The Law Office of Burch & Clarke represents families in transition during divorce or custody and visitation negotiations in Tennessee.

The office understands that divorce is tough on everyone—even if the final outcome of the change is positive, there is no such thing as an “easy divorce.”

We know you need direction, information, and advice from a kind, trusted source and that you need your rights and wishes aggressively protected in mediation or trial.

Our family law practice strives to make the legal process around divorce as streamlined and fast as possible, so that clients can focus on restructuring a new kind of life for themselves and loved ones, especially children.

Filing for Divorce in Tennessee

Tennessee offers the opportunity for both fault and no-fault divorces.  Our office helps clients with both.

If you want to file a no-fault divorce, we need to know the substance of the agreement with regard to property, debts, children, and child support.  We draft a marital dissolution agreement and a permanent parenting plan, if applicable.  A typical no-fault divorce finalizes in sixty to ninety days.

If the spouses disagree as to a matter or grounds for fault exist, then the divorce takes a different turn—you may need to go to mediation or trial.  These types of divorces typically involve more time and effort from the client and then attorney.  We take the time to work with you through this difficult process.

Custody and Visitation

Tennessee child custody and visitation arrangements are based on the best interest of the child.
This is a legal standard whereby you need an attorney who can show the court how your lifestyle and what you provide serves the best interest of the child.

If you believe your spouse’s lifestyle suits the child better on a more permanent basis, our office helps arrange for the visitation that keeps your relationship strong and your child supported and aware of your love.

There are many creative opportunities to serve the best interest of the child.  Whatever truly is best is what we will help you figure out and manage, so that the legal resolution is as efficient as possible.

We understand that children do not need undue stress during divorce—and neither do you.
