How Workers’ Compensation Works in Tennessee

When you hurt yourself at work, you are required to report the injury to your employer as soon as it happens.  This is an important step in securing benefits for yourself as they are owed under the Tennessee state law that protects you. 

When an employee is injured, the employer is supposed to fill out a form and offer the employee a panel of at least three physicians from which to choose to visit for medical treatment.  The employer must maintain multiple types of paperwork to that effect, including information about the choices for doctors and information about how that choice was decided and agreed to.

The injury is reported to the insurer by the employer and the employee, in theory, is supposed to receive medical care. 

Compensation payments for an injury are supposed to be paid to the worker no later than fifteen days after the occurrence of the injury and insurers have thirty days to make an offer of settlement. 

If these timelines are not met—or, even worse, if the offer of settlement falls short of the true value of the injury—you need an attorney to stand up for your rights.
